Court to Reexamine Ruling That Allowed Former President to Deploy Troops to Portland

The federal appeals court has maintained a ban on deploying state troops in Portland, Oregon, following a latest court ruling.

Appeals Court Agrees to Reconsider Legal Matter

The ninth circuit court of appeals ruled on Tuesday that it would reexamine the case concerning the executive power with an expanded panel of 11 judges. The judicial body also overturned a earlier ruling from a smaller judicial group that had sided with the federal government.

Legal Saga Over Military Presence

This order represents the latest development in a protracted legal battle over whether the administration has the legal right and justification to send national guard forces in Portland. Approximately 200 federalized guard members have been in limbo since late September when the mobilization attempt was started in due to ongoing demonstrations.

Conflicting Arguments

The federal government has argued that federal officials at the immigration center in south Portland were under attack, while city and state officials maintain that local officers have command of the situation.

In defiance of descriptions of Portland as a conflict zone, locals have been posting footage of scenic paths and a thriving food scene, and organizing activities such as an protest bicycle event against the “militarization of our city”.

Recent Legal Actions

The Tuesday ruling came after a federal judge in Portland enacted two legal injunctions this period – one blocking the federal control of the state troops, and another stopping the deployment of any national guard troops in the state, after attempts to circumvent the initial injunction by mobilizing out-of-state forces.

On the previous day, the ninth circuit panel had put the first ruling on hold – permitting control of 200 Oregon national guard – but the subsequent injunction stayed effective, blocking the actual deployment of the troops.

The latest ruling means the matter will be heard by the full court – with all decisions under review together – by a panel of 11 judges.

“This decision demonstrates that facts are important and that the judicial system are working to ensure government responsibility. The constitution limits the executive authority, and local populations cannot be treated as a training ground for expansive government power,” stated the legal representative in a statement.

“The court is sending a definite signal: the president cannot dispatch the military into US cities without cause. We will continue defending state legislation, values, and sovereignty as this case progresses and our fight continues in the judicial system.”
